  1. About Us
    These Terms and Conditions apply to all products, courses, exams, and services supplied by Training Byte Size Pty Ltd (ABN 32 639 277 93), registered office at 16/2 Waterfront Place, Robina, QLD 4226, Australia (“we”, “us”, “our”).

By purchasing any product or service from us, you agree to be bound by these Terms and Conditions.

  1. Australian Consumer Law
    Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law.

  1. Digital Products and Cooling-Off
    Digital products, online courses, and downloadable materials do not include a statutory cooling-off period under Australian law.

Change-of-mind refunds are not provided unless expressly stated at the time of purchase. However, we will assess all requests on a case-by-case basis. If you believe a product or service does not comply with Australian Consumer Law, please contact [email protected].

  1. Prices and Payment
    All prices are listed in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.

Prices may change at any time, but changes will not affect orders that have already been confirmed.

Despite our best efforts, pricing errors may occasionally occur. If an error is identified, we reserve the right to correct the error and either contact you for instructions or cancel the order and issue a refund.

Payment must be received in full prior to course access, exam booking, or delivery of materials, unless otherwise agreed in writing.

Where instalment payments are agreed, all instalments must be paid by the due dates specified. Failure to make payment may result in suspension of course access, withholding of certificates, or cancellation of services.

  1. Risk and Title
    Access to products, courses, and materials will only be granted once full payment has been received, including any applicable taxes.
  2. Intellectual Property
    All intellectual property rights in all products, courses, and materials remain the exclusive property of Training Byte Size Pty Ltd or its licensors.

Upon purchase, you are granted a non-exclusive, non-transferable licence to use course materials solely for your own personal, educational, and non-commercial purposes.

You must not copy, reproduce, distribute, publish, resell, sublicense, or otherwise make available any materials to any third party without our prior written consent.

  1. Public Classroom Courses
    Public courses are delivered by approved trainers in venues arranged by us. Class sizes typically range from 4 to 16 delegates.

To secure a place, full payment or a valid purchase order must be received no later than 14 days before the course start date.

Joining instructions and pre-course materials are usually issued approximately two weeks before course commencement. Travel and accommodation should not be booked until the course is confirmed.

We reserve the right to change course content, dates, trainers, or venues (to a comparable local venue), or to cancel a course if required. Reasonable notice will be provided wherever possible.

  1. Public Course Cancellations
    Cancellations must be submitted in writing.

More than four weeks before course start: no charge
Two to four weeks before course start: 50% of course fee
Less than two weeks before course start: 100% of course fee

Non-attendance without cancellation will be charged in full.

  1. Transfers and Substitutions (Public Courses)
    Transfers to another public course date are permitted as follows:

More than four weeks prior: no charge
Two to four weeks prior: AUD $250 + GST per delegate
Less than two weeks prior: transfers not permitted

Delegate substitutions are permitted at no additional charge provided the substitute meets course prerequisites and we are notified in writing at least two weeks before the course start date.

  1. In-House / Corporate Courses
    Once an in-house course is confirmed, preparation costs are incurred immediately.

Payment terms will be agreed at booking. Unless otherwise stated, invoices are payable within 14 days and prior to course delivery.

Cancellations must be submitted in writing:

More than four weeks before course start: no charge
Two to four weeks before course start: 50% of course fee
Less than two weeks before course start: 100% of course fee

One transfer to a later date is permitted provided:

  • Written notice is given at least two weeks before the original start date
  • The original invoice is paid within one week of the original start date

Additional transfers or cancellations may incur full fees.

Clients are responsible for any venue damage caused by their delegates.

  1. Exams – Public Test Centre and Online
    Exams are booked only after full payment is received.

Once an exam is booked, it is non-transferable and non-refundable unless otherwise stated.

Exam rescheduling or cancellation fees apply as follows:

More than 30 days before exam: no charge
15–30 days before exam: 50% of exam fee
8–14 days before exam: 75% of exam fee
1–7 days before exam: 100% of exam fee

Failure to attend an exam or attempt the exam will be treated as a sitting.

Candidates must comply with all examination body registration and identification requirements.

  1. Online Exams
    Online exams must be booked and completed by the expiry date provided. Failure to do so will require repurchase of the exam.

Photo identification (passport or driver licence) is required at the time of the exam.

Provisional results are issued immediately, subject to verification by the examination body. Certificates are issued by the examination body and timelines vary.

  1. Warranty
    We warrant that our services will be provided with due care and skill and that products will materially conform to their descriptions.

All other warranties are excluded to the maximum extent permitted by law, subject to Australian Consumer Law guarantees.

  1. Liability
    Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian law.

Our total liability for any claim is limited to the amount paid for the relevant product or service.

We are not liable for indirect, consequential, or economic loss, including loss of profits, revenue, business, or data, to the extent permitted by law.

  1. Force Majeure
    We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, government actions, or infrastructure failures.
  2. Data Protection
    Personal information is handled in accordance with our Privacy Policy and applicable Australian privacy legislation.
  3. Written Communications
    You consent to receiving communications electronically. Electronic communications satisfy any legal requirement for written notice.
  4. Notices
    Notices must be sent to [email protected]. Notices sent by email are deemed received within 24 hours.
  5. Complaints
    Complaints should be submitted to [email protected].

We will acknowledge complaints within three business days and aim to resolve them promptly and fairly.

  1. Appeals
    Appeals relating to certification decisions must be submitted in writing within six months of the assessment date. Appeals are handled impartially and in accordance with examination body requirements.
  2. Assignment
    You may not assign or transfer your rights without our consent. We may assign or subcontract our obligations as required.
  3. Severability
    If any provision is found unenforceable, the remaining provisions remain in force.
  4. Entire Agreement
    These Terms constitute the entire agreement between you and us.
  5. Variation
    We may update these Terms from time to time. The version in force at the time of purchase applies.

Governing Law
These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction.
